What Forced Arbitration is
Forced Arbitration is published by Madgett Law, LLC, a Minnesota law firm, and is attorney advertising.
It is written by David J.S. Madgett, Minnesota Bar No. 390494, who is responsible for its content.
What it is not
It is not a government agency, is not affiliated with the Minnesota Attorney General or any other government office, and is not a legal aid or public interest legal services organization.
- Not advice about your situation. This site reports what named companies’ own contracts, court records, and public data from arbitration providers and the federal government say, as of the dates stated. It is general information, not legal advice about your situation, and reading it does not make us your lawyers.
- Not an accusation of wrongdoing. What this site says about a named company comes from a source named where it is used: the company's own document, quoted word for word and dated; a court record; or public data published by an arbitration provider or a government agency. Where we sort clauses into categories, the method is on the Methodology page. We make no claim about any company's motives, and we do not say any company acted unlawfully; where a court used a word, we quote the court and name the case. Whether a given clause is enforceable, or unlawful, in any particular case depends on facts this site does not have.
- Not a claim intake. There is no form on this site at launch. Contacting the firm directly, by phone or email, does not by itself create an attorney-client relationship.
If you contact the firm
If you contact the firm, Madgett Law, LLC will keep what you send confidential, whether or not we take your case. Please do not send confidential, sensitive or time-critical material before we have run a conflicts check. Under the Minnesota Rules, a firm that receives information which could be significantly harmful to someone can be disqualified from a matter — so sending too much too early can cost you the lawyer you wanted.
We make no promises about outcomes
We do not promise that any clause is unenforceable, that any case will be filed, that a case would succeed, or that we will take any particular matter.
Sources and corrections
Company contracts on this site are quoted word for word, either from a dated copy we fetched and recorded or from a court record. A copy we fetched came from the company’s own site, from a government agency’s website such as the Consumer Financial Protection Bureau’s credit card agreement database, or from a dated archival snapshot, and each document’s page in the clause database says which. Where the report quotes a company document from a court record, it names the case. Every figure comes from a named source. If you find an error, tell us. We will check it against the source, and if we got it wrong we will correct it, date the correction, and say what changed. See Corrections. See Methodology.
Trade name
Forced Arbitration is a trade name of Madgett Law, LLC. An assumed-name certificate for it has not been filed with the Minnesota Secretary of State.
Where this is available
